Functions

  • To advise the Government on any matter concerning prevention, control and abatement of air and water pollution.
  • To collect and disseminate information relating to pollution for public awareness.
  • Regulation of Industrial activity by issuance of Consent for Establishing and Operation of Industrial units as per section 25/26 of the Water (Prevention & Control of Pollution) Act, 1974, and as per Section 21 of the Air (Prevention & Control of Pollution) Act, 1981.
  • Grant of Authorization for Hazardous waste management under HOWM Rules 2016, Biomedical waste management under BMWM Rules 2016 and Plastic waste management under PWM Rules 2016 as prescribed under EP Act 1986.
  • To advise the Government with respect to the suitability of any premises or location of industries which is likely to cause Water and Air pollution.
  • To collaborate with the Central Pollution Control Board,Delhi for prevention, control or abatement of water and air pollution, implementation of different schemes like NAMP, NWMP etc and to organize mass education programmes relating thereto.
  • To perform such other functions as it may think necessary for the proper discharge of its functions and generally for the purpose of carrying into effect the purposes of Water Act, Air Act and Environment Protection Act.
  • The Committee has also been nominated as State Nodal Agency under the Environment Education Awareness and Training (EEAT) programme of the Ministry of Environment, Forestand Climate Change, Government of India (MoEFCC, GoI).

Major Acts & Rules Governing the Functioning of the JKPCC:

For the abatement and control of pollution in  J&K, the PCC enforces the provisions of various Environmental laws as under:-

  • The Water (Prevention and Control of Pollution) Act, 1974.
  • The Air (Prevention and Control of Pollution) Act, 1981.
  • The Public Liability Insurance Act, 1991.
  • The Environment (Protection) Act, 1986, various rules notified thereunder.
  • Orders issued by Hon’ble National Green Tribunal / Hon’ble High Court / Hon’ble Supreme Court of India.
